According to the documents, "plaintiff and defendant have been unable to agree as to the equitable distribution" of their marital property. It goes on: "Plaintiff [Kate] is and has always been willing to negotiate a fair and reasonable settlement."

It also seems Kate was pretty shocked by the divorce even though it seemed pretty obvious to most everyone else. She told People.com "I curled up in a ball and I sobbed. I couldn't breathe; I was hyperventilating. I was scaring people who were calling to check on me because I couldn't even talk."
